Exemption Justification:
Due to time constraints, it was not possible to follow the standard approval protocol for Sole Source and meet the national deadline of (1/18/13), for mortgage claims filed as part of the National Mortgage Settlement Multistate Group (NMSG). Florida had a smaller percentage of claim forms returned compared to other states and the deadline was rapidly approaching. The decision was made to engage Rust Consulting to place phone calls to identified Floridians that had not returned a claim form, thus providing another opportunity to do so and obtain a refund payment. Rust Consulting was selected as a result of a bid process negotiated by the NMSG, and was the only vendor that had the contact list of names and signed confidentiality agreements with the various banks thus having access to the financial records of the former mortgagees needed to meet the requirements for a refund. No other firm had that access and could meet the deadline.
