Dear Office McCampbell:

You ask whether a "Go-Ped" is subject to the motor vehicle laws. Attorney General Butterworth has asked me to respond to your letter.

You state that the "Go-Ped" has no seat or saddle and no pedals to propel it. From the information attached to your letter, it appears that the "Go-Ped" is a motorized scooter with two wheels, powered by a gasoline engine which may achieve a maximum speed of 20 miles per hour.

In Attorney General Opinion 93-45, this office considered whether a similar type of vehicle was subject to the state's traffic laws. In that opinion, this office stated that a motorized scooter powered by a gasoline engine with a maximum speed of 20 miles per hour may be characterized as a "motor vehicle" pursuant to section 316.003(21), Florida Statutes, and the drivers and operators of these scooters are subject to the provisions of Chapter 316, Florida Statutes, governing vehicles and vehicles traffic.
