Attorney General Moody and Multistate Coalition Defeat Biden Administration’s Green Agenda in Court

TALLAHASSEE, Fla.—Attorney General Ashley Moody is announcing a federal judge blocked the Biden administration’s highway emissions rule that tried to drive gas-powered cars off the road. In a 21-state coalition of attorneys general, Attorney General Moody brought a challenge in the U.S. District Court for the Western District of Kentucky against the Federal Highway Administration’s rule that attempted to force states to reduce CO2 emissions on the roads.   

Attorney General Ashley Moody said, “This court decision is a major victory against Biden overstepping his authority to push a radical political agenda on Americans. Biden’s highway emissions rule would have harmed our state’s opportunities for future economic development. We will continue fighting to protect Floridians’ interests against federal overreach.”

If the FHWA’s rule had not been struck down, it would have required states to set targets to reduce greenhouse gas emissions from on-road sources. Multiple states commented that the FHWA rule may cause the elimination of future economic development and job creation projects. 
  
The attorneys general of the following states joined Attorney General Moody in filing a challenge to the FHWA rule: Alabama, Alaska, Arkansas, Idaho, Indiana, Iowa, Kansas, Kentucky, Mississippi, Montana, Nebraska, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Utah, Virginia, West Virginia and Wyoming.
