Attorney General James Uthmeier Announces Multiple Arrests in Organized Retail Theft Scheme
TALLAHASSEE, Fla.—Attorney General James Uthmeier announced that Herbert Davis III, Michael McCray, and Tyrone Howard were arrested and charged with first and second-degree felony burglary charges following a joint investigation between the Martin County Sheriff’s Office and the Office of Statewide Prosecution.
“Florida law enforcement and our statewide prosecutors are taking the fight against retail theft to the next level,” said Attorney General James Uthmeier. “We will leverage all necessary tools to keep prices low for Floridians and create an environment that allows businesses to thrive.”
The masked defendants burglarized various athletic footwear stores at the Jensen Beach Mall on October 21, 2025, a Georgia mall on November 7, 2025, and the Volusia Mall in Daytona Beach on November 17, 2025. They were captured on video climbing a ladder to reach the roof and then entering the store by cutting a hole in the ceiling.
The group stole hundreds of sneakers valued at over $70,000.
The defendants will be charged as follows:
- Burglary of a Structure Causing Over $1000 in Damage
- Grand Theft Causing Damage Over $1,000
- Possession of Burglary Tools (while masked)
- Unlawful Use of a Two-Way Communication Device
Following the theft at Jensen Beach Mall, two of the defendants attempted to burglarize another store in Daytona Beach, where they were caught and arrested by the Daytona Beach Police Department.
Senior Assistant Statewide Prosecutor Chris Olowin will prosecute this case.
If convicted, the defendants each face a maximum penalty of life in the Florida Department of Corrections.
Recently, Attorney General Uthmeier announced the Retail Theft Special Investigative Task Force to eliminate jurisdictional red tape and enable prosecutors to file more substantial charges.
