Attorney General Reaches Agreement with Palm Beach Business over Hurricane Protection Systems

TALLAHASSEE, FL – Attorney General Bill McCollum today announced that his office has reached a settlement with a Palm Beach County business over the marketing of hurricane protection systems. As part of the settlement, Florida Window Company, LLC and its owner, Scott Berman, will pay over $118,000 in consumer restitution and $10,000 to the Attorney General’s Seniors v. Crime project.

The Attorney General’s Economic Crimes Division began investigating the company’s practices in May 2007 after receiving numerous complaints from Florida consumers. Investigators determined that the company contracted with numerous consumers to install windows, doors and hurricane protection systems in Palm Beach and Broward counties, but allegedly failed to complete contracted projects in a timely manner, if at all. Further, the company allegedly substituted inferior products for those contractually agreed upon, failed to secure required permits in a timely fashion and inadequately responded to consumer complaints related to the contracted services.

As part of the settlement, Florida Window Company, LLC will voluntarily and permanently dissolve. The company and its owner fully cooperated with the investigation and have already reimbursed $68,835 in excess of the amount of restitution agreed upon in the settlement. The resolution of the case was assisted by the Broward County Building Permit Department.
