Lawsuit Against AC Company Victimizing Seniors

TALLAHASSEE, Fla.—Attorney General Ashley Moody today announced a lawsuit against Air Time Air Conditioning and Heating, Inc. and its principal Anthony Gonzalez. Air Time allegedly deceived many consumers, including seniors, with high-priced quotes for unnecessary service or unneeded replacement of air conditioning systems or parts.

Attorney General Ashley Moody said, “It is outrageous that a company would swindle consumers with such deceitful business practices. Our office is committed to investigating allegations of illegal conduct and enforcing the laws that protect consumers. Taking advantage of unsuspecting seniors and other consumers will not be tolerated in Florida.”

According to the complaint filed in Hillsborough County, numerous consumers were told by Air Time that high-priced repairs were needed; however, upon obtaining second, outside opinions from other HVAC companies, the complainants learned that the high-priced repairs were excessive and unneeded. The complaint also alleges that Air Time failed to include in the service contract the required notice of the customer’s right to cancel a contract within three days.

The Attorney General’s Office learned of Air Time’s alleged deceptive practices when a complaint was directed to the Attorney General’s Senior Protection Team from the Attorney General’s Office’s Senior vs. Crime Project—the daughter of an 89-year-old customer reported that her mother spent more than $21,000 on air conditioning parts and services with Air Time in less than three years, and Air Time would not provide an itemization of the bills.

Consumers who have done business with Air Time since June of 2017 who believe that they may have been victimized by this company are encouraged to contact the Attorney General’s Office at (813) 287-7950.
