Attorney General McCollum sends letters to U.S. Attorney General, BP

Attorney General McCollum today sent letters to U.S. Attorney General Eric Holder and the General Counsel of BP America regarding the Gulf Coast Claims Facility (GCCF) and the current protocol developed by Ken Feinberg. The Attorney General stated that the people of the Gulf Coast cannot be “made whole” through payments from BP if the GCCF provides fewer protections to and imposes greater burdens upon the victims of the Deepwater Horizon oil spill than the federal Oil Pollution Act of 1990 (OPA) requires. The Attorney General asked Attorney General Holder to meet and discuss the matter on behalf of Florida citizens and businesses.

“As Florida’s chief legal officer, I must insist on a fair and efficient claims process, consistent with the requirements of OPA,” wrote the Attorney General to Attorney General Holder. “As it currently stands, the emergency payment protocol and claims process…may well hamper injured parties as they seek to be made whole.”

The Attorney General also reminded BP that the company is responsible for providing a credible claims process, consistent with the requirements of OPA, for Florida individuals and businesses who have suffered losses because of the Deepwater Horizon disaster. The inequitable result would be harmful to the public and would not be in BP’s long-term interests.
