Allegation or issue being investigated: Violations of FSS 501 Part I and II arising from misleading and deceptive statements in advertising. Company offers foreclosure rescue services via mail solicitation and advertisement on their website. The website claims that the company can “stop” foreclosure, that consumers will not have to file bankruptcy, that they have been in business since 1985, that they are the nations must trusted foreclosure rescue firm, and that the company can improve a consumer’s credit score. The company also has a refund policy that guarantees that the company will refund 100% of the consumer’s fees if the company cannot negotiate a foreclosure alternative. Based on a complaint received from legislative sources, this company is not honoring the refund policy. Additionally, the company operates under the unregistered fictitious name of Fix the Foreclosure, Inc. Lastly, it is suspected that the company may be in violation of 501.1377 or Florida’s Foreclosure Rescue-Related Services Act by charging up-front fees and failing to disclose required information to the consumers. |
