2009 Session of the Florida Legislature

Today is final day of the 2009 Session of the Florida Legislature, a session which has been full of difficult decisions for all involved. I commend our lawmakers for their leadership in these challenging times and for the efforts they have made to protect Floridians.

I believe significant progress has been made toward safeguarding Floridians’ investments and promoting public safety. The Legislature passed the Florida Securities and Investor Protection Act, an important piece of legislation which allows the Attorney General to seek civil penalties and restitution for victims of securities fraud and provides better tools for criminal prosecution of these crimes.

The Legislature also strengthened the CyberCrimes Against Children Act, approved federal stimulus funding for four additional forensic analyst positions for my CyberCrime Unit, and continued its support of the Coordinating Council on Criminal Gang Reduction Strategies, one of my top priorities. Funding was also secured to support the Council on the Social Status of Black Men and Boys, which is housed in my office.

With the current state of our economy, these have been trying times for our state, our citizens, and our leaders. It is during times like these that those that would prey on our vulnerabilities come out in full force, therefore the Attorney General's Office will be doing everything possible to protect our consumers, our businesses, and our public entities from the unscrupulous deeds of others.



CyberCrime Update

Attorney General McCollum joined the Hillsborough County Sheriff’s Office in announcing the arrests of four Tampa area men on charges of possession of child pornography. The investigation, which is ongoing, is a joint operation by Hillsborough County Sheriff David Gee’s detectives and the Attorney General’s CyberCrime Tampa Task Force.

Attorney General McCollum announced the arrest of an Orlando man on charges of child pornography possession. Simon Ferguson was taken into custody today by law enforcement with the Attorney General's CyberCrime Unit with assistance from the Orange County Sheriff's Office.
Consumer Protection

Attorney General McCollum announced that his office has filed a lawsuit against an Orlando loan modification company alleging the company was committing foreclosure rescue fraud. Three Angels Community Action Network and company president Sherrard A. Haugabrooks are named in the lawsuit filed today in Seminole County Circuit Court. The lawsuit specifically alleges violations of Florida’s Foreclosure Rescue Law, §501.1377.

Attorney General McCollum announced that his Economic Crimes Division has reached a settlement with a nationwide telephone directory company resolving allegations of deceptive business practices. US-Yellow: National Business Book agreed to modify its business practices so that its direct mail solicitations would no longer resemble local yellow pages telephone directory invoices and improve disclosures related to its automatic renewal provision. The company has already reimbursed customers over $85,000 either through restitution or cleared account balances.
Criminal Proceedings

Attorney General McCollum announced that a Columbia County man has pleaded guilty to his involvement in a mortgage fraud scheme. Rory V. Porter faces five years in prison and ten years of probation when he is sentenced next month and will have to pay over half a million dollars in restitution. Porter was prosecuted by the Attorney General's Office of Statewide Prosecution.

Attorney General McCollum joined the Metropolitan Bureau of Investigation (MBI), the Florida Department of Law Enforcement and the U.S. Drug Enforcement Administration to announce the arrests of 18 members and associates of a dangerous narcotics-trafficking gang located in Central Florida. The investigation into the Westside gang was initiated as part of a concerted effort of regional law enforcement agencies in accordance with the Attorney General's Gang Reduction Initiative.
